Objective

To protect threatened species and their habitats.

Recommendation

It is recommended that the Tasmanian Government conducts a public review into the effectiveness of the operation of the National Parks and Wildlife Act 1970, the Forest Practices Act 1985 and the Threatened Species Protection Act 1995 in establishing agreements and conservation covenants with private landowners to protect threatened species habitat.

This information is available from Volume 2 of the last SoE Report (SDAC 1997), which can be downloaded. The final objective, final recommendation, and a summary of key management actions are detailed below.

Actions taken

A number of legislative amendments have been undertaken since this recommendation was put forward as part of the previous SoE Report (1997). These include: a review of the Threatened Species Protection Act 1995 and the preparation of the Threatened Species Strategy, and the splitting of the National Parks and Wildlife Act 1970 into the National Parks and Reserves Management Act 2002 and the Nature Conservation Act 2002. The Threatened Species Strategy and the Nature Conservation Strategy embody a legislative review component.

The Forest Practices Act 1985 has been amended and this amendment is relevant to the Threatened Species Strategy. The Forest Practices Code has also been reviewed.

The Private Forests Reserve Program and the Protected Areas on Private Land Program have used current legislation to covenant and reach agreements with land-owners on private land, and have not seen the current legislation as a significant constraint.
